Bill 119 – Mandatory WSIB Coverage Update
Despite the fact that Bill 119 was passed in November 2008, it has yet to receive Ministerial proclamation, leaving the issue surrounding mandatory WSIB coverage for Independent Operators and Executive Officers unsettled. It is possible that Bill 119 could be proclaimed as early as December 15, 2011. At the time of proclamation, the pre-registration timeframe for companies to send information to WSIB to start processing would begin, however premiums would not have to be paid until December 15, 2012. Until the legislation is proclaimed, firm timelines as well as certain policies that WSIB must implement will remain unknown.
Although there are certain exemptions, if and when Bill 119 is eventually passed, it will result in additional costs for construction companies in Ontario, as coverage will be expanded to include independent operators, sole proprietors, partners in a partnership and executive officers of a corporation.
